Judge Rules Q'Comm Must License Modem Patents
A U.S. federal judge issued a preliminary ruling requiring Qualcomm license some of its modem IC patents to competitors including Intel and Samsung.
The ruling, issued by U.S. District Court Judge Lucy Koh in San Jose, was made in a case involving the U.S. Federal Trade Commission (FTC), which last year sued Qualcomm for engaging in anti-competitive tactics to maintain what the FTC called a monopoloy in the supply of baseband chips.
According to media reports, Koh's ruling said Qualcomm is required to license patents based on agreements to provide licenses that the company entered into with industry groups. Media reports said the FTC and Qualcomm asked Koh to delay the ruling for up to 30 days while they engaged in settlement talks, but that Koh denied the request.
Qualcomm did not immediately respond to an EE Times request for comment.
The Qualcomm-FTC case is scheduled to go to trial in San Jose in January.
