曝国家市场监管总局突击爱立信北京办公室：接到举报，立案侦查

近日国家市场监管总局突击检查电信设备商爱立信北京办公室，并进行现场取证。此前，业内已有传言称多家手机厂商向市场监管总局举报，投诉爱立信在3G和4G标准必要专利（SEP）许可市场存在违反《反垄断法》的行为。

　　

此次突击行动，标志着国家市场监管总局已经根据手机厂商的举报进行立案调查。这也是继高通反垄断案之后，国家反垄断监管部门在知识产权许可市场领域发起的第二次反垄断调查。此外，深圳市中级人民法院还曾审理了华为与IDC的知识产权反垄断诉讼。

　　

需要指出，目前三次知识产权反垄断案件，均发生在通信领域。移动通信一直是全球知识产权许可的主要市场，但由于中国移动通信产业起步较晚，大部分2G/3G/4G标准必要专利集中在高通、爱立信、诺基亚等欧美企业手中，绝大多数中国企业在专利的申请、许可谈判等领域才刚刚起步，缺少经验。

　　

2011年以来，爱立信的知识产权业务收入达到97亿美元。而爱立信的专利收入则主要来自两个渠道，一方面是与全球约100家企业达成专利许可协议。另一方面，则是将部分标准必要专利出售给诸如Unwired Planet（无线星球）等NPE专利机构，后者通过专利的授权、转让获得收入并于爱立信分成，此举可以规避FRAND条约标准必要专利许可的约束。
